Appearing on the November, 2010, ballot in California will be The Regulate, Control and Tax Cannabis Act of 2010, designated Proposition 19. If approved by a majority of voters, the Act will legalize, under state law, the personal cultivation, possession and transport of less than an ounce of marijuana by an adult, and authorize local governments to regulate and tax the production, distribution and sale of commercial cannabis.

Assemblyman Tom Ammiano has filed a bill, AB69, that would would provide permissible regulation on the state level if Proposition 19 passes.

Below are the municipalities that have drafted ordinances to accomplish local regulation and taxation:

The City of Long Beach has put an item on the November 2, 2010, ballot. If it is approved by the voters, the City will be among the first to regulate and tax commercial production and distribution of cannabis.

The City of San Jose will have a ballot measure on November 2 that taxes "marijuana businesses" at 10% "to provide funding for essential Cit y services such as police, fire, emergency response, street maintenance, pothole repair, parks, libraries and youth and senior programs." The only "marijuana business" is currently medical marijuana business, but the measure does not distinguish between medical and non-medical marijuana.
