The 2010
California Initiative |
Appearing on the November, 2010, ballot in California will be The Regulate, Control and Tax Cannabis Act of 2010, also called the Lee Initiative (and hereinafter called the "Act"). If approved by a majority of voters, the Act will legalize, under state law, the personal cultivation, possession and transport of less than an ounce of marijuana by an adult, and authorize local governments to regulate and tax the production, distribution and sale of commercial cannabis.
The significance of this initiative cannot be overstated. If enacted by the voters, the new law will reform California's marijuana laws consistent with regulation and taxation, making California the first state to lift its marijuana laws out of a distant and racist past shared by all Americans. Hugely significant is that it will force Congress to start thinking about the right of states to regulate and tax this commodity.
